If you do not agree, do not use the Service.We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.---2. EligibilityYou must be at least 13 years old to use YumCrumb. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not intended for children under 13.---3. Your AccountTo access certain features, you must create an account. You agree to:- Provide accurate and complete registration information
- Keep your password confidential and not share it with others

- Be responsible for all activity that occurs under your accountWe reserve the right to suspend or terminate accounts that violate these Terms.---4. User-Generated Content4.1 Your Content
YumCrumb allows you to post reviews, ratings, photos, and other content ("User Content"). You retain ownership of your User Content.By submitting User Content, you grant YumCrumb a worldwide, non-exclusive, royalty-free, sublicensable, transferable, and perpetual license to use, display, reproduce, distribute, modify (for formatting), and promote your User Content within the Service and in connection with marketing and promoting YumCrumb.Users must only upload photos they own or have rights to. By uploading, you represent that you have all necessary rights, including publicity and privacy rights of any people appearing in your photos.4.2 Your Responsibilities
You are solely responsible for your User Content. You represent and warrant that:- You own or have the rights to post the content
- Your content does not violate any third-party rights, including intellectual property or privacy rights
- Your content complies with these Terms and all applicable laws4.3 Content Standards
You agree not to post content that:- Is false, misleading, or fraudulent
- Is defamatory, obscene, offensive, hateful, or harassing
- Depicts or promotes illegal activity
- Contains nudity, explicit sexual content, or graphic violence
- Infringes any copyright, trademark, or other intellectual property right
- Contains spam, advertising, or unsolicited promotions
- Includes personal information of others without their consent
- Is posted by automated means or bots4.4 Content Moderation
We reserve the right (but not the obligation) to review, remove, or edit any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. We may also suspend or terminate accounts of repeat violators.4.5 Reporting Objectionable Content
You can report content that violates these Terms using the in-app reporting tools or by contacting us at [email protected]. We will review reports and take action within a reasonable time.---5. Prohibited ConductIn addition to the content standards above, you agree not to:- Use the Service for any unlawful purpose
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Interfere with or disrupt the Service or servers connected to it
- Scrape, crawl, or collect data from the Service without our written permission
- Reverse engineer, decompile, or disassemble any part of the Service

Intellectual PropertyAll content, features, and functionality of the Service — excluding User Content — including text, graphics, logos, icons, and software, are the exclusive property of YumCrumb or its licensors and are protected by applicable intellectual property laws.You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.---7. Dispute ResolutionBinding Arbitration and Class Action WaiverAny dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Service (collectively, “Disputes”) shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes, except that you may assert claims in small claims court if your claims qualify.The arbitration will be conducted in Miami-Dade County, Florida. You and YumCrumb agree that any arbitration will be conducted on an individual basis only, and not as a class, collective, or representative action. You and YumCrumb each waive any right to a jury trial.You may opt out of this arbitration agreement by sending an email to [email protected] within 30 days of first accepting these Terms.Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.---## 8. Third-Party Services and LinksThe Service may contain links to third-party websites or integrate with third-party services (such as sign-in providers). We do not control and are not responsible for the content or practices of those third parties. Your use of third-party services is governed by their respective terms and privacy policies.---9. Apple-Specific TermsIf you downloaded YumCrumb from the Apple App Store, the following additional terms apply:- These Terms are between you and YumCrumb only, not Apple.
- Apple has no obligation to provide maintenance or support for the Service.
- In the event of any failure of the Service to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the Service.
- Apple is not responsible for addressing any claims by you or third parties relating to the Service, including product liability claims, consumer protection claims, or intellectual property infringement claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you.---15.
